Jamie Foxx has responded to yesterday’s news that a sexual assault claim had been filed against him for an incident alleged to have happened in 2015. Variety reported on Wednesday that the actor is being sued for reportedly groping a woman at a rooftop bar in New York.

In a statement released to The Independent, Foxx’s spokesperson said:

“The alleged incident never happened. In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter. The claims are no more viable today than they were then. We are confident they will be dismissed again. And once they are, Mr Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action.”

In the case, the plaintiff, referred to as Jane Doe in the lawsuit, has brought forth allegations that paint a picture of that night at the Catch NYC rooftop lounge. According to the lawsuit, Doe met the Django Unchained actor and Mark Birnbaum, the bar’s owner, while seated at a near table. The incident reportedly took place after midnight when Doe’s friend approached Foxx for a picture.

After posing for several photos and reportedly showering Doe with compliments, he reportedly told her, “Wow, you have that super model body” and “You smell so good.” Afterwards, he is said to have led her to a secluded corner of the rooftop. The suit further alleges that the assault took place on the rooftop.

Doe claims that Foxx, under the guise of casual interaction, proceeded to grope her in a sexually aggressive manner. The description of the assault is graphic and unsettling, involving unwanted touching beneath her clothing. The suit further claims that the actor reportedly “put his fingers on and in Plaintiff’s vagina and anus.”

The suit also claims that a security guard saw what was happening but chose not to get involved. The lawsuit points to this as a glaring failure in the duty of care expected at such establishments. The intervention came only when Doe’s friend returned, prompting Foxx to cease his actions and leave the area. This legal action is not merely about seeking justice for a single night’s events. It encapsulates a quest for recompense for the significant emotional and physical distress Doe claims to have endured, including the need for medical attention following the incident.

Foxx, who was hospitalized earlier this year, is not the only one named in the lawsuit; Birnbaum and Catch NYC are also defendants. They are accused of creating an environment that enabled such an assault and failing in their duty to supervise effectively. The suit against Foxx was just one of several high profile cases to be logged ahead of a deadline to file lawsuits under a New York law that suspended time constraints on claims involving allegations of sexual misconduct for one year. Others named in similar suits on Wednesday included Axl Rose and Cuba Gooding Jr., while a new lawsuit was brought against comedian Bill Cosby on Tuesday.
